End User License Agreement (EULA)
1. Acceptance of Terms
By downloading, installing, or using the AfterWords Software, you agree to be bound by this EULA. If you do not agree, do not use the Software. This EULA works together with our Privacy Policy and Subscription Terms.
2. License Grant
AfterWords grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software for personal, non-commercial use; and to upload, store, and manage content (including voice, images, and text) to create legacy messages.
You may not reverse-engineer, resell, sublicense, or misuse the Software or Services.
3. Ownership
We retain all rights in the Software, Services, and brand assets. You retain ownership of your uploaded content, subject to the license in Section 4.
4. User Content
You grant AfterWords a limited license to process, store, and generate derivative works to deliver the Services; and to transmit messages per your settings. You represent that you have rights to upload all content and that it does not infringe third-party rights.
5. Subscriptions & Payments
Premium features require a paid subscription. Subscriptions auto-renew unless canceled as described in the Subscription Terms. Fees are non-refundable except as required by law, and pricing may change with reasonable notice.
6. Privacy & Security
We encrypt data in transit and at rest and handle sensitive content according to our Privacy Policy.
7. Consent & Legacy Control
Certain features require consent from designated executors or family members. You are responsible for ensuring compliance with applicable laws and recipient permissions.
8. Limitations of Liability
The Services are provided “as is.” To the fullest extent permitted by law, we disclaim indirect or consequential damages. Our aggregate liability will not exceed amounts paid by you in the 12 months before a claim.
9. Termination
We may suspend or terminate access for EULA violations. Upon termination, your license ends and you may request export or deletion of content.
10. Governing Law
This EULA is governed by the laws of [State, e.g., Delaware], without regard to conflicts of law.
11. Dispute Resolution
Disputes are resolved by binding arbitration in [Location], except where prohibited. Class actions are waived.
12. Updates
We may update this EULA. Continued use constitutes acceptance.
